EAD申请问题请帮助，感激不尽。

我的情况：
H1B， EB3 485 PENDING. May get laid off soon, so need to apply EAD.

ON FORM 765

Qestion 11. have you ever before applied for employment authorization from USCIS. should I check yes or no? I have never applied EAD before, but applied H1B before.


Question 16,Eligibility categories. 我是不是填 (c)(9)?

I filed 485 at end of June, 2007, so do I need to pay the $340 fee or it is waived.
