昨天接到学校international office的通知,说我的H1-B延期申请到现在还没有递交,因为他们正在等一个什么LCA的东东.可是我的H1 8-15号就要到期了.学校建议我申请H4,作为新旧H1B之间的过渡.
-I do not think you need to change your status to H4 now. Just wait for the LCA to file the H1 application. Usually it takes about one week to get the LCA. Also, there is 10-day grace period after H1 status expires. So, I do not think there is any problem for your H1 petition approval.

1. H4申请,一般需要多久才能收到receipt?
-10 days to 2 weeks.
是不是只要I-539就行,还需要其他的表格吗?
-Yes.
I-129需要不?
-No.

2. 除了I-797/I-94/pay stub(双方), 婚姻证明,passport(自己),还需要什么材料?
-Enough.

3. 学校还是要帮我办H1延期的.如果我的新的H1下来了,可是H4还没有,我是不是需要写信去withdrawal? 怎么写? 就说I need withdraw my h4 application?
-Write a letter to USCIS with your H4 receipt.
申请费是不是可以refund?
-No.

4. 有没有这种可能性: 新的H1下来了,可是H4已经无法withdraw. 这样我的H4下来后,H1就自动失效.这就意味着我不得不重新申请新的H1?
-Yes. If your H4 approval is after your h1 approval, your final status will be H4, and thus you need to file an application to change H4 to h1 again.
