回复：一个关于AP180天的问题

请教一下，我是485pending(跟随丈夫一起递交的)。我两年前毕业，没有申请OPT，现在也没有工作（但申请了EAD）。最近申请了AP。请问在从中国回到美国时用ＡＰ会不会有问题？
-You did not tell us when you filed the I-485 after you graduated, nobody can answer your question correctly.

我问这个问题是因为今天485面试，local的officer警告说如果在美国没有合法身份180天之后，用AP可能海关会不让放行。在此想请教过来人，这种情况下用AP会有问题吗？
-It is true if you were unlawyful presence > 180 days before you filed your I-485. Also, you can not get your green card either in this case unless you married a U.S. citizen.
