The dilemma of diversity policy in employment based immigration
Dear .....,
Employment based immigrants are subject to per-country quota, which means every year each country in each category (e.g. EB1, EB2, or EB3) can only take at most 7% (that is 2800) of the total number of that category. The objective of such diversity policy is to make people, even from countries with small population, still have opportunities.

However current policy allows counties that used up their own quota to use the spared numbers from other counties WITHOUT LIMITATION. This had result in, for example, that India born EB2 immigrants took 21% of total EB2 numbers in FY 2008, three times of the normal limit. The reason is almost all the spared number from other country was used by indian born. This fact TOTALLY DEFEATED the diversity policy and is unacceptable by people from other countries.

I strongly solicit you to pay attention to this issue. If diversity is not addressed enough by “Visa Lottery” and family based immigration, then it makes more sense to set a PROPER LIMITATION of using carry-over visa numbers from up-level category for each country of each category, such that carry-over visa numbers may be distributed over more countries. If diversity is addressed enough in “visa lottery” and family based immigration, then per-country limit for employment based shall be lift. Diversity may be abided by.
