Your lawyer is very inexperienced. It is very basic sense that the I-485 applicant (you) have to sign the Form I-485 before it was sent out.

-For the RFE, if you can find some evidences you were in U.S. (such as 用过信用卡, etc.) 1-3 days before and after the date your I-485 was signed, I think it will be OK. You just find some excuses and explain why you forgot signing this form.
