急！！！这种情况申请绿卡需要补做J1 waiver吗

01年留学欧洲，03年1月从欧洲申请来美，当时在欧洲美国领事馆拿的是J-1签证，并且有 2 years Foreign Residency Requirement的限制。



2003年9月交换实习后，我们回到了欧洲继续读本科。 并于2005年7月在欧洲完成了本科学历。



2005年8月我们再次从欧洲申请来美国攻读硕士，拿的是F-1 签证，（在欧洲使馆签证时，工作人员在我们以前的J-1签证上盖了一个大章：（canceled without prejudice）



2007年4月，我们在美国硕士毕业后，找到工作，转为H-1（EB3)工作签证。



2007年7月我们递交了I-140申请绿卡。



2009年3月我们的I-140顺利通过.



目前I-485 pending, 由于我们2003年第一次来美国时的J-1签证上有2 years Foreign Residency Requirement的限制，我们很担心在申请绿卡时会有麻烦，但律师跟我们讲由于我们已经用不同的身份，F-1签证入美，并且又取得了H-1签证，这就说明J-1的身份已经结束了，在申请绿卡的时候不会有影响，这是否属实？这种情况是否还需要在做J-1waiver, 我们的I-485 已递交，现在补做waiver是否来得及？
