Discuss this with the lawyer and ask him/her to file the petition when you are in U.S. as we talked last night. If the lawyer does not accept this suggestion, you may talk to the Human Resources whether you can find a new lawyer (you may pay the lawyer fee by yourself if you have no choice).

I can tell this lawyer is not experienced and not skilled either.
