You do not have any problem and just go ahead to prepare the documents for the RFE. It seems your lawyer is not familiar with the INS Memo (5-16-00) H/Ls Who Work After Entering on Advance Parole. You may remind him/her this memo if you use him/her for this RFE or find another good lawyer if you think you need a lawyer.
