回复：F1未毕业转H1，中途回国问题

本人情况为，PHD读了一年半，目前有个non profit的工作机会，提供H1，想quit PHD 直接去，但是在H1的办理期间想回趟国。看了以前的帖子，说如果在转身份期间回国，就会被认为是自动放弃H1的申请，不知道这种说法对吗？
- The approved H-1b, regardless where you are at the time, is still valid, not the COS. You will need to use it to apply H-1b visa, and may come to US no more than 10-day before its effective starting date.
However, you can still come back in F-1 (say H-1b is pending, or prior to 10-day of effective date), in such case you need to file I-129 to COS or get re-entry in H-1b visa so as to start working.
