Ask question on H4

H4 approval notice (2005-2006) was undeliverable, due to moving home 3 years ago. Now, we are going to apply for H4 in China. How much is the risk as illeaglly stay? Now H4 is still valida.
We called USCIS and were told that US consulate in China can see the aproval. Attorney here said there is a risk to bar since we did not get the notice.
