I just tell what I could suggest.
File a EB1 at once and apply for AP for 17 old child at the same time. Let this child go abroad (China, Mexican or Canada) to get a new I-94 right after AP arrives. With this new I-94 and a valid AP, your child can apply for Fiancial Aid as AOS.
Keep your H1(?) meanwhile for safety.
