It has to be filed by deadline, that's the bottom line. USCIS is giving you a chance and will accept your re-filing, thus keep your case within the administrative system. If you miss this chance, your case will be thrown to judicial system and be ruled by immigration judge and deal with ICE. But I think your chance of removing condition is good even in court because your USC hu*****and will support your claim.
