- When H-1b is laid off before expiration and the employer notifies USCIS, the H-1b is considered OOS when remaining in US. In such situation, so is H-4.
When USCIS is not notified the termination of H-1b, it is normally ok as long as I-94 being valid (though factually it is OOS, just USCIS does not pay close attention).

Academic institute does not know the status of primary H-1b, and has no way to know it.
