You are asking a question that is in the grey area of the law. Technically, your O-1 petition were filed when you were in valid H-1B status. Working on the EAD in the mean time, may complicate this and could make you ineligible for a change of status. Therefore, if you wish to avoid possible complications, I recommend applying for premium processing at this time.
