必须出境申请新的I-94吗？

我的律师给我申请H1B时居然没有按"Change of Status",因为我的旧TN过期日和H1B生效日的gap....所以我的H1B没有I-94。

这种情况下，我必须出境申请新的I-94吗？入境有风险吗？
