The 2003 Yates memo made it very clear that you cannot waive the jointly part of I-751 when your marriage is not yet terminated. So you must file jointly I-751 first, and later refile a waiver I-751 after divorce final. Or if you cannot get the spouse to jointly file by the expiration, you may need to do it later by the cancellation of removal proceeding before immigration judge.
