Since you are out of status only for 3 weeks,
if your lawyer can filed H1-B soon, say one week,
you can stay in USA to waite the result.

5 weeks out of status is the same as 3 weeks.

Better to get H1-B result before leave states,
Check with you lawyer before you decide to leave USA.
