You probably wrote in I-765 that you are current H4, but in fact your H4 is obviously expired. That's this RFE is about. Just explain that you are not in H4, you wrote H4 by mistake but you are in I-485 pending, and you are eligible under (c)(9) to get EAD. You will still get one.
