Pijiang teacher and 863211 teacher: Please advise

My J1 will be expired on Jan.31, I decided to file EB1A, but I could not finish my preperation by Jan.31, could I ( legally) file EB1A by the middle of Feb. ( which means in my grace period)? or better to file within my legal status? Is there any defference to file in Jan. and Feb.? Thanks a lot
