H1 -> H4 help please!

Company will be out of business 50 days later. 140 and 485 were filed concurrently a week ago. I am a dependent and waiting for my EAD.

Questions:
1) Without changing to H4, am I legal status after 2/12/09? I am H1B until 2/12/09. Do I need to apply H4?
2) If change to H4, I was told that the H4 application should be submitted 2 weeks before H1B expired, otherwise, I was not get paid by current employer --- Is this True?
3) If change to H4 in State, am I legal once I get the application receipt? Is it OK without H4 being approved?
4) Do I need to apply H4 aboard? I know not too much time left for me.
