If your employer doesn't tell anything to USCIS,you can stay in USA without any problem.When you apply for a new TN Visa,you only tell immigration officer that you previous job end and you get a new job offer.You are not required to provide any previous employer's information such as paychek,etc.You are only required to provide Job offer and Job title.I knew a person,he did like this.
Please also remember that as a Canadian,you can stay in USA legally as Visitor for maxum 180 days without any visa.
Anyway you had better double chek with your attorney.
