untimely filed EOS can be denied by the reason of untimely filed, but not necessary, Especially when you filed it nunc per tunc.
If you must stay, then you will stay and accept for possible denial (and unlawful days accumulation). If approved, your pending time will be considered, in retrospect, lawful status.
