Sorry, you have no right to file I-290B to appeal the denial. The visa officer has the absolute authority to approve or deny your immigration visa and his action cannot even be reviewable by Secretary Rice!

You have two choices:

1) try to enter on H/L nonimmigrant visa and then file I-485

2) try to send request letter to the Department of State to trigger internal review. It is easier to trigger internal review by asking help from congressman. Your hu*****and should hire an attorney to handle this.
