MTR for wrongly denied I485

My info:

Labor approved on 7/6/2007. PD:3/8/2007.
140 & 485 filed on 7/25/2007 and received on 7/26/2007, notice date 9/18/2007.
140 approved on 4/21/2008 and wrongly stated receipt date as 9/17/2007.
485 interviewed on 11/20/2008.
11/29/2008 got the denial notice from mail indicating my 485 filing date was 9/19/2007 when the visa number was not current with my 3/8/2007 PD.For this reason I was not entitled to filing I485.


I will have my lawyer to file MTR. I have looked at the I290B form which is quite confusing. I want to get a quick answer: "Do I need to get my employer to sign anything on I290B form for MRT or I need to sign on it"

Can anyone share some similiar experience?
