本人持H-1B，EB2，485 递交已过180天，同时持EAD, 我女儿的I-94 为09年1月19日到期，本月突然失去工作，如果我在11月内找到工作，转换H-1B 的话， 请问女儿是否要在1月19日前换I-94?

If your daughter is in H-4 and the I-94 will expire on 1/19/2009, further if you want to keep her in H-4 status after that date, you must file H-4 extention and get a new I-94 for her based on your new H-1b. Otherwise she will lose her authorized stay as H-4 dependent.


我的新公司要求我现在急需回中国出差，时间为5个月，请问我是否可以在EFILE TRANSFER H-1B后即回中国？待收到正式批准书后， 让公司寄给我？还是我一定要等到有收据号后才能回国？还是一定要等到收到正式文本后才能回国？

If the transfer is not approved during the time when you stay in China, you will have trouble to get back as H-1b worker. Further, since you are not in H-1 status while your transfer petition is pending, your I-485 is deemed to have been abandoned when you leave this country unless you have approved AP. To reduce the risk, I suggest you to have the transfer approved before leaving this country.
