H4 headache problem

In 2005, I applied for h4 for my family for 2005-2006. The notice was sent to my old address before I have a time to change my address to USCIS. The notice was regarded as undelivable and returned back to USCIS. It was not sent to me again even we got a notice for our application for 2006-2009.

Our university attorney said there is risk that the visa officer in China may think my family was illegally staying here during 2005-2006, so suggest me get it using G824 form to get an orignal copy. It costs a big money.

I called USCIS days ago. The staff said she saw the noitce there and the visa officer in China can see also. As long as we have the current H4, there will be no question to re-issue a h4 from China. She suggest use G639 to get a copy of the notice. It is free.

Who is right and what shall I do? Thanks
