1. 移民局一般建议B2延期在I-94过起45天之前递交, 可是又说至少要在I-94过期前递交. 我们不在乎延期是不是会批准, 只是想能让我婆婆合法地在美国呆到明年3/3. 所以我们想能拖就拖. 请问11/10/08左右递交延期是不是可以?
-可以, but you had better send the application out two weeks before the I-94 expires to make sure USCIS receive your application and put it into their system.

2. 如果我们于11/10/08递交延期申请, 我婆婆的护照还有6个月有效期. I539的Instruction上说"Valid Passport. If you were required to have a passport to be admitted into the United States, you must maintain the validity of your passport during your nonimmigrant stay." 也就是说我婆婆的护照在3/3/2009之前都是没有问题的, 我们的理解对吧?
-No problem at all. 护照6个月有效期 only applys to the person for entry to U.S., not for the person already present in U.S.

3. B2延期是一定要送I-94的原件吗? I539的Instruction上说"是", 可是网上又有人说复印件也行, 你觉得呢?
-Photocopy is much enough.

4. B2延期一般要多久才有消息? 我们是期望它拖的越长越好. 如果三个月以后才有回音, 即使是被denied, 我婆婆也是可以合法地呆到明年3/3号. 11/10/08 + 3 months + 1 month grace period = 3/10/2009. 你觉的我们这个想法可行吗?
