急请教：这种情形是否会out of status

My case sounds complex, please help:

I am on H4 status, will expire on Oct. 4 this year, my hu*****and hold H1, will expire on Aug. 2009 (CBP make a mistake but don't want to correct it). I submitted I-539 to extend status on Sept. 18. Now application pending　（application A pending). On March 2009, my hu*****and and I renew H1/H4. If on next Aug. 2009, renewed H1/H4 (application B) are approved but my previous H4 extend application A is still pending and pass the previous H1 expired time (Aug. 2009).
Question 1:
Do you think I can get application A approved ?(as I guess not since it pass the time)
Question 2: Am I out of status since Oct. 4?
