If an H-1B uses AP to return to U.S., he can still work as long as it is still the same H-1B position. However, within 1 year, he or she has to file H-1B extension to restore the H-1B status. Otherwise, once AP expires, the alien will be in AOS that means he can only use the EAD to work and H-1B status may be lost.
