the lawyer told me that waiver and J1 extension are different issue, it means that they are not conflict, go for J1 extension first, it is safer, otherwise you can only stay in the US for another 2 months for the grace period, during the grace period, you can work, even as a volunteer, you have to stay at home. and at the meantime, start your H1-b petition too.
