1. I was applying for accountant position. Company A was a small CPA firm. Even if there was only me and my boss on the payroll, they approved that position cause that is what accountant should work for. My salary was doubled in Company B but it is not a CPA firm. We called it private industry. Even there are twenty payroll employees and 25 million annual sales in Company B, INS denied the accoutant position. There is another H-1b petition got approved in B. His position was marketing manager. So it is different.

But anyway, they approved with exactly the same material. Officer A denied it and officer B approved it.

2. This is my first time that I heard transfer denied. So nothing is absolute. I was scared. Company B had filed LC for me but it will be a while. They told me to stay illegal and adjust my status according to 245 i, which might (only might) be extended this year. But I don't think it is good idea. I think the worst case was to beg Company A issue me ONE paycheck and redo the transfer. That's very hard for me because my ex-boss told me never walk back in that door again if I walk out.

3. I still not suggest premium at the first transfer. If you got rejected in 2 weeks, you might not be able to react in time.
