我今年二月底失去工作, 公司付钱到四月底, 我的H1上的I-94 5月12日过期. 我在5月9日开始F2 pending, 后找到工作, 8月18日申请了H1. 现两个申请都要补材料.
F2要补银行statements和一张最新的I-20(当时转F2准备太仓促了). H1要补5月8日前的工资单, 单位信证明5月8日前还在公司工作,和2007年税表.
不利条件是最近发现公司在把我解雇时发信通知了移民局, 我妻子F1的OPT这个月底到期.
昨天已经寄出了F2补件. Cover letter里要求F2有效期从5月到H1生效.

H1补件还没交. 5月8日前的工资单和2007年税表我能提供, 但单位不会出信证明5月8日前还在公司工作.

请问现在这种情况F2, H1 能不能被批? H1是不是要到境外去签? F2会不会被拒?

- I don't think much trouble so far, however it may be an issue when your spouse's OPT terminates, and the grace period ends and your petition has yet come to a decision.
