Please help: H1 transfer rejected due to application fee payment

Hello all,

My friend's H1 transfer was just rejected due to some problem with the check.
Is he out of status already? There are 2 options he is considering:

1). Appeal to re-open the case (Or just re-submit the application again)? Would he be out of status while the appeal is going on?

2). Apply for H4. Would he be considered out of status during this H4 application period? Does he need to leave USA before the application is approved?

Also, is there a grace period (1 month?) that he has before making decision to do either of these?
