急! 求教H1, 护照, 境外激活, security check方面的难题

我今年五月初头三年H1到期, 公司因效益不好不愿再办H1延期, 我在H1过期前几天申请了转F2, 现在是F2 pending, 最近找到了工作, 公司可以支持H1, 我妻子已毕业, OPT 八月底到期, 我现在困惑的是:
1. 我现在在美国身份是否合法? H1 能不能被批? 我一定要到境外激活吗? F2 pending 是不是可以合法留在美国, 我能不能不到境外激活(能不能得到I797A, not I797B)? 我不知道I-129表填写是否有窍门?
2. 我的护照年底到期, 这样是不是要先换护照? 但换护照要一个多月(纽约领事馆), 而我现在F2 pending, H1过期怎么换护照?
3. 如果是I797B要境外激活, 我是不是可以选择去加拿大多伦多, 墨西哥, 或者回国到上海去签? 因为我要换护照, 是不是我可以回国换护照再签证? 国内我的案例签证是不是风险比去加拿大签大?
4. 我工作是与材料工程有关, 属于敏感专业, 有没有方法避免security check?
