If his I-94 does not expire yet, his lawful presence has no any problem even if he is out of status for a couple of weeks. Also, if his old employer does not report his discontinuation of employment to USCIS before his new employer file his H-1 transfer petition to USCIS, his H-1 transfer will completely get approved with I-94 issue. So, just relax and nothing to worry about.
