When you file COS to H-4, you need an H-1b approval which is valid at the time of filing, or a pending H-1b petition which covers the date of your filing.
Once the I-539 has been received, you may consider your status of H-4. You're in authorized stay while COS is pending.
If you consider to go back China, you don't need to file I-539 but simply apply H-4 visa at consulate.
