The letter from USCIS doesn't mention the depart time, such as 10 or 30 days. Just say that from now on the stay is illegal. I checked the related email in this site. Anyone has clearer answer for my questions:
1)the illegal stay should be counted from the date of denial or the date receive the letter.If they leave right now, is there any effect for their future visa application and green card application in China?
非法滞留期从拒绝之日起算。没有影响,因为你的非法滞留期只有不长的若干天而已,只有长达至180天以上才会有重大的影响。
2)Our valid I-94 issued to Oct2007, since there is no valid I-94 after that, is the stay in between these dates legal?
不太明白你的问题。你是说你父母的前次的I-94有效期到10月么?那么你这次为他们申请延期太早了!这很可能就是被拒绝的原因。Anyway,他们可以合法居留到I-94到期日为止。
3)If we apply for Green card for them in US, just pay penalty ($1000) or so, the over stay has no effect for them to get green card?
对,没有影响。只要是合法入境即可,随后出现的非法居留只要交罚款即可。
