if divorce is unavoidable, do it fast. According to Yates memo on I-751 waiver, now, divorce must be final for this waiver to be valid. Otherwise, without final divorce but no joint I-751 in time, you will go through longer process and request "de novo" later.
Once I-751 timely filed, you will get one year extension upon receiving the receipt.
