The laywer is wrong. You can not do H-1 transfer anymore because you use the EAD and did not maintain your previous H-1b status. You can apply for a H-4 status within U.S. or go back to China to get H-4 visa. After you get H-4 status, you can apply for H-1B again within U.S. You also can ask your current employer file a H-1b petition for you and ask USCIS send the approved document to a U.S. consulate in China. Then, you can go back to China to get H-1 visa in that U.S. consulate.
Anyway, use the Premium Processing for the H-1B petition.
