请问 PJIANG: do I need to apply for H4 visa in this case?

My hu*****and used AP last time he entered US. Our attorney told us that his H1B visa became invalid after using AP. Is this true?

I currently hold H4 visa (expired 09). If not using AP, do I need to apply H4 visa again for next entry to visa, since my hu*****and H1B visa is no longer valid?
