485 pending without H1 is deportable

今天跟律师谈了一下.原因是我485 pending已经超过半年,问是否可以转工作用EAD.
她的回答大部分跟版上的意见是一样的,similar or same position.
多了一条新的:她说从几个月以前,有了新的对485 pending的解释:485 pending without H1b is deportable.
她说这是STUPID的,YET SCARY.她是第一次见到用这样的词来形容485 pending without H1b, 强烈建议我仍然拥有H1作为最保险的方法.
不知道大家有什么看法.谢谢.
