If O-1 is preferred, the applicant may withdraw H-1B petition after the O-1 approval notice is received. Otherwise, last rule may apply.

However, if the H-1B change of status is denied while consular processing is approved, H-1B will not automatically kick in on Oct. 1 because the beneficiary has to leave the country to apply for H-1B visa at the designated consulate. Without obtaining H-1B visa, the alien may still maintain O-1 status.
