The burden of proving all legal status since your last entry lie on you. If you don't have the B1 I797, did you have the copy? or at least keep the bottom part of the I797A, which is B1 I-94? If B1 is still your current status and you don't have any of the above, you must file I-102 to get replacement I-94 which is the proof of current non-immigant status.
