1。 我的140批了,485待批〉180天。目前的状态是H1b,未申请工卡。如果我目前的工作6月30日结束,新工作8月1日开始,中间的gap 是合法的吗?这会不会对绿卡造成影响?
If you does not apply for H-1B transfer, you will be in AOS only. It means you are not out of status. Your EB pending application does not require you to work during the pendancy. Therefore, there is NO gap.
2.通过考古,有人说题了485,就是AOS, 有gap 也没关系.但是,如果这样,是不是意味着我在新的工作后,就不能用h1b,而应用工卡?
You can keep your H-1B status if you can transfer your H-1B from your current employer to the new employer. However, the beginning date of your H-1B employment with the new employer should be the ending date of your H-1B employment with the old employer. If there is an H-1B "gap", you are not maintaining an H-1B status. Your H-1B transfer petition (extension) may as well be denied. You may have to apply for EAD to work for the new employer.
3。 另外,我的新旧工作基本是一样的(工作性质,研究方向)。都是大学教职,可是因为是不同的系,所以后面带专业是不同的。这会不会被当作是不同的工作而据绿卡?
It really depends on your job duties on your labor certification. You may consult an immigration attorney to compare the two positions. The worse senario is that USCIS may send you a RFE. Or, if you have discussed with your new employer's HR and obtained their full cooperation in writing a positive employer support letter, you will be fine.
4。 另外,我的绿卡申请,我有140的申请receipt,approval notice 的复印件,及 485 receipt.但我没有perm approval letter. 请问在新的工作开始后,如果有rfe之类的事,我需要备有这些材料吗? 或者说,我应该向我的目前雇主要那些材料已备不时之需.
You should request a copy of all your immigration documents, including perm, filed by your current employer. You may get a copy from the HR or employer's attorney in charge of your case.
