How to WOM argue,请教 donkeyroad 等高手

FBI name check (pending for 3 yrs) cleared after filing WOM. But the priority date is not current. The AUSA says in MTD that visa number is not available. How can I argue to oppose the MTD about visa number being not available? No chance to win? Thanks a lot.
