Help! PJiang & Xiaobaotu

My hu*****and is holding multiple entries H-4 visa until August 2008. He plans to go back China around May. My company lawyer said that if we have H-visa new extension for 3 years approved before he comes back from China. My hu*****and can use the approved H-4 visa paper when he enters to US to get new expire date. This means my hu*****and doesn't need to apply a new visa in China and he can get 3 year visa in the border. Is this correct? Could you please help me ASAP? We are thinking if we need to apply premium H visa extension. Thanks a lot.
