回复：H1/EAD问题请教pjiang老师（看了您的博客，还是不解）和各位老师

1. 如果4月申请新H1（应该是基于我现在有效的H1），理论上会很容易被批准并拿到I-797A（10月生效），但是当我7月份使用过ead之后，这份I- 797A是否还有效并且于10月生效呢，也就是说，10月份我的H1身份会自动激活而我并不用出境再签从AOS转回H1？
- Strictly say, you will need to get H-1 visa after 10/1 due to using of EAD.
Assuming your current H-1 good through 10/1 at least, you may start working for new employer upon filing H-1 xfer, until approval notice with validity date beginning at 10/1. Say you receive approval notice in Aug, you may resume working for previous employer till 10/1. In this way, you're fine staying in US.

2. 如果上述情况是对的，当10月份我的身份转回H1之后，我的AOS应该是自动void了，这是否会对我pending的485造成影响？（上有人说会void掉pending的485，我觉得不会但又不太确定）
- Your reinstate to H-1 has no affect on your I-485.
