I am writing this letter to express my deep concern with Department of State
's arbitrary interpretation of law and reckless exercise of the power
granted by the American people and their representatives in Congress, which
are reflected in the Visa Bulletin issued by the agency for April 2008.
The Department of State (DOS hereafter) mandates in the Visa Bulletin that:
"Section 202(a)(5) of the Immigration and Nationality Act provides that if
total demand will be insufficient to use all available numbers in a
particular Employment preference category in a calendar quarter, then the
unused numbers may be made available without regard to the annual "per-
country" limit. It has been determined that based on the current level of
demand being received, primarily by Citizenship and Immigration Services
Offices, there would be otherwise unused numbers in the Employment Second
preference category. As a result, numbers have once again become available
to the India Employment Second preference category. The rate of number use
in the Employment Second preference category will continue to be monitored,
and it may be necessary to make adjustments should the level of demand
increase substantially."
It was astonishing to see that DOS assigned the potentially unused numbers
from WORLD-WIDE Employment-based category two to only ONE country rather
than ALL countries whose cutoff dates were not current. I found no
compelling reasons of doing so in above bulletin. On the other hand, it is
rather not astonishing if I consider this decision as a natural continuity
to the chaotic job done by DOS in recent years, e.g. the sudden leap of
priority dates in July 2007.
What truly worries me is the sharp contrast between the chaos and the
streamlined work I have seen from many other federal and local governmental
agencies. The contrast demonstrates a lack of governance and the abuse of
administrative power exist in an important federal governmental agency. I
am even more upset when I realize that this agency, along with the
Citizenship and Immigration Services, keeps the gate of this country to
those who are in search of justice and fairness and pursuing a dream life on
this new continent. Yes, the NEW continent.
I sincerely hope that the Congress to look into this incident and look for a
permanent solution to stop the chaos.
