I am an I140&I485 concurent filer in last July ,since I am from BEC like
many folks here, now I am thinking of a situation that may affect some of us , let's imagine that many of us now have an approved I140 ,and our I485 maybe picked up and adjudcated by an IO at anytimes,but what if :
1. you company is laying off you (for me , my current project may run out of money this year but don't know when and what's the probility).
2. if you are laidoff and obviouly you will be looking for new position
immediatly.
3. then while you are still looking around for a new position in order to
applying AC21 , your case might being picked up by a IO to adjucate since your
PD is current now, and the IO issue a RFE for your employment status...see ,
this is the problem because at the time you are still in the middle of seeking a new position.
This situation is worrying me today and I would really appreciated if anyone
has any experience on this . As one of BEC victim , I really don't want to
be turned down at last moment!
By the way , I haven't applied EAD card yet since I feel my PD is Feb 2004 and should be current shortly.
