The I-129 was denied because Part 5 Item 8 of I-129 is earlier than dates on LCA. I tend to think you don't have a case when filing I-290B.

Since you may have been out of status now, I would file a new I-129 with PP, and expect to get a visa at a consulate. If you change employer, no difference.

Whether or not you may carry your PD, depends on your current I-140 status.
